Getta Drawer Terms of Service

Last updated: 13 August 2026

1. About these Terms

These Terms of Service set out the general terms that apply when you use the Getta Drawer website, request a quotation, purchase products or services from us, or engage us to undertake work.

In these Terms:

  • "Getta Drawer", "we", "us" or "our" means Getta Drawer and its business operator.

  • "Customer", "you" or "your" means the person or entity purchasing or requesting our products or services.

  • "Products" means goods supplied by Getta Drawer, including drawers, cabinetry, hardware, benchtops, stone, porcelain and related products.

  • "Services" means services provided by Getta Drawer, including consultation, site measuring, design, supply, installation, modification and related services.

  • "Quote" means a quotation or proposal issued by Getta Drawer.

  • "Project" means the products and services described in a Quote or other accepted agreement.

These Terms apply together with the applicable Quote, invoice, scope of work, drawings, specifications and any written variations agreed between Getta Drawer and the Customer.

If there is an inconsistency between these Terms and a specific written Quote or agreement, the specific written agreement will generally apply to the extent of the inconsistency.

2. Website use

You may use the Getta Drawer website for lawful purposes, including:

  • learning about our products and services;

  • submitting enquiries;

  • requesting quotations;

  • providing project information; and

  • contacting us.

You must not:

  • misuse the website;

  • attempt to gain unauthorised access to our systems;

  • introduce malicious software;

  • copy or reproduce our website content for commercial purposes without permission;

  • interfere with the operation or security of the website; or

  • use the website for unlawful purposes.

We may update, suspend or withdraw parts of the website from time to time.

3. Enquiries and preliminary information

Information provided through our website, social media, telephone conversations or preliminary discussions is generally intended to help us understand your requirements.

A preliminary discussion, indicative price or estimate does not constitute a binding Quote unless expressly stated otherwise.

Where measurements, photographs or other information are supplied by you, we may use that information to prepare an initial assessment or estimate.

A final price may depend on a site inspection, site measure, product availability, design requirements and other project conditions.

4. Quotations

Our Quotes will generally describe the products and services included and the applicable price.

Unless otherwise stated in writing, a Quote may be subject to:

  • confirmation of measurements;

  • confirmation of site conditions;

  • product availability;

  • supplier pricing;

  • final design;

  • access conditions;

  • structural or installation requirements; and

  • any assumptions or exclusions stated in the Quote.

A Quote is not accepted until the acceptance requirements stated in the Quote have been satisfied.

We may specify an expiry date for a Quote.

If a Quote expires, we may need to review pricing and availability before accepting an order.

5. Acceptance of a Quote

A Project may be accepted by:

  • signing or otherwise accepting the Quote;

  • confirming acceptance in writing;

  • paying the required deposit; or

  • another method expressly stated in the Quote.

Once a Quote has been accepted, the parties will have entered into an agreement for the agreed Products and Services, subject to these Terms and any specific written terms in the Quote.

6. Deposits and payments

A deposit or progress payment may be required before we commence particular stages of a Project.

The amount and timing of payments will be stated in the applicable Quote or invoice.

Depending on the Project, payments may be required for:

  • design or preparation;

  • site measuring;

  • materials;

  • custom-made Products;

  • manufacturing;

  • stone or porcelain;

  • hardware;

  • delivery;

  • installation; or

  • progress stages.

A deposit may be used to secure materials, manufacturing capacity, supplier orders and project scheduling.

Deposits and cancellation

A deposit is not automatically non-refundable in all circumstances.

If you cancel a Project, or if the agreement ends, we will assess the circumstances, including:

  • work already performed;

  • Products already ordered or manufactured;

  • materials specifically purchased for your Project;

  • reasonable costs incurred;

  • amounts already payable to third parties; and

  • any rights you have under applicable law.

Nothing in these Terms is intended to exclude or restrict any refund or cancellation rights that cannot legally be excluded.

7. Site measures

Where a site measure is required, we may arrange an appointment to inspect and measure the relevant area.

A site measure may be required before we can confirm final dimensions or proceed with manufacture.

Customers must provide reasonable access to the property at the agreed time.

If access is unavailable, the area is not ready, or circumstances outside our control prevent the measure from being completed, an additional attendance or site-measure charge may apply where reasonably applicable and disclosed.

8. Customer-provided measurements and information

If you provide measurements, drawings, photographs or other information for the purpose of quoting or manufacturing Products, you are responsible for ensuring that the information you provide is accurate to the best of your knowledge.

Where Getta Drawer relies on customer-provided information without conducting a site measure, we may not be responsible for problems caused by inaccurate, incomplete or misleading information supplied by the Customer.

Where we conduct our own site measure, we will use reasonable care in taking and recording measurements.

9. Existing cabinetry and property conditions

Many Getta Drawer Projects involve modifying or working within existing cabinetry, cupboards, kitchens, laundries, wardrobes or other structures.

Existing cabinetry and building conditions can vary considerably.

We may identify potential issues before or during installation, including:

  • damaged cabinetry;

  • water damage;

  • uneven floors or walls;

  • out-of-square cabinets;

  • inadequate fixing points;

  • plumbing or electrical services;

  • insufficient clearances;

  • structural issues;

  • existing damage;

  • deterioration;

  • non-standard dimensions; or

  • conditions that were not reasonably visible before work commenced.

Where an existing condition affects the Project, we will discuss the issue with you where reasonably practicable.

Additional work may require a variation to the original Quote.

10. Custom-made Products

Many Products supplied by Getta Drawer are custom-made or ordered specifically for the Customer's Project.

This may include:

  • drawers;

  • cabinetry;

  • internal drawer systems;

  • panels;

  • benchtops;

  • stone;

  • porcelain;

  • hardware; and

  • other Products manufactured or ordered to particular specifications.

Because custom Products are made or ordered for a specific Project, they may not be suitable for resale to another customer.

However, nothing in these Terms limits any rights you have under the Australian Consumer Law, including rights relating to faulty, defective, unsafe or otherwise non-conforming Products.

11. Product colours, materials and variations

Samples, photographs, displays and digital images may not perfectly represent the final colour, texture, pattern or finish of a Product.

Natural and manufactured materials can have variations in:

  • colour;

  • pattern;

  • texture;

  • veining;

  • gloss;

  • grain; and

  • surface appearance.

Natural stone, porcelain and other materials may have variations that are inherent to the material.

Where a particular Product, colour or finish is selected by the Customer, we will supply the selected Product subject to availability and the manufacturer's specifications.

12. Stone and porcelain

Where stone or porcelain is included in a Project:

  • slab availability may affect final layout;

  • patterns and veining may vary;

  • joins may be required;

  • cut-outs may be required for sinks, cooktops or other fixtures;

  • site conditions may affect installation;

  • final dimensions may depend on completed cabinetry; and

  • manufacturer or fabricator requirements may apply.

Where a Customer requests a particular slab, pattern, layout or vein direction, additional material or fabrication costs may apply if stated in the Quote or subsequently agreed.

13. Design and drawings

Where Getta Drawer provides drawings, sketches, layouts or design information, they are prepared for the relevant Project.

Unless otherwise agreed, drawings and design concepts remain the intellectual property of Getta Drawer.

You must not reproduce, distribute, modify or provide our drawings or designs to another contractor for commercial use without our written permission.

This does not prevent you from using information reasonably necessary to use or maintain Products supplied to you.

14. Variations and additional work

A variation may be required where the scope of work changes after the Quote has been accepted.

Examples include:

  • changes requested by the Customer;

  • additional cabinetry;

  • changes to dimensions;

  • changes to materials or finishes;

  • additional site work;

  • unforeseen existing conditions;

  • additional demolition or preparation;

  • additional installation work;

  • additional stone or porcelain;

  • changes requested after manufacturing has commenced; or

  • work required because of information that was unavailable when the original Quote was prepared.

Where reasonably practicable, we will provide the Customer with the additional cost before proceeding.

Where urgent work is reasonably necessary to protect the Project or property, or where obtaining prior approval is impracticable, we may take reasonable steps to address the issue and discuss the additional cost with the Customer as soon as practicable.

15. Changes requested by the Customer

Once Products have been ordered, manufactured or work has commenced, changes may result in additional costs or delays.

We will advise you where reasonably practicable if a requested change affects:

  • price;

  • manufacturing;

  • delivery;

  • installation;

  • materials; or

  • the expected completion date.

A requested change will only be accepted where it is reasonably practicable for us to implement it.

16. Manufacturing and lead times

Estimated manufacturing, delivery and installation timeframes are estimates unless a specific date has been expressly agreed in writing.

Lead times can be affected by:

  • supplier availability;

  • manufacturing capacity;

  • material availability;

  • transport;

  • weather;

  • site readiness;

  • other contractors;

  • building works;

  • changes to the Project; and

  • circumstances outside our reasonable control.

We will use reasonable efforts to keep you informed of material delays.

17. Installation and site access

The Customer must provide reasonable and safe access to the site for agreed work.

The Customer is responsible for advising us of known hazards or relevant site conditions.

Where reasonably necessary, the Customer must ensure:

  • access paths are available;

  • the work area is reasonably clear;

  • relevant services are accessible;

  • other trades have completed prerequisite work;

  • required plumbing or electrical work has been completed; and

  • the site is reasonably ready for installation.

If the site is not reasonably ready, installation may need to be postponed.

Additional costs caused by repeated attendances, waiting time, storage or other reasonably incurred expenses may apply where disclosed or agreed.

18. Protection of property

We will take reasonable care when carrying out work at your property.

However, renovation and installation work can involve risks to existing surfaces and finishes.

Existing cabinetry, flooring, walls, tiles, paintwork, benchtops and other finishes may already have defects, deterioration or weaknesses.

We will take reasonable care but cannot guarantee that an existing finish will not be affected where the nature of the work reasonably requires interaction with it.

Where we identify a significant risk before proceeding, we will discuss it with you where reasonably practicable.

Nothing in this clause excludes liability that cannot lawfully be excluded.

19. Customer responsibilities

The Customer must:

  • provide accurate information;

  • provide reasonable site access;

  • disclose relevant known site conditions;

  • obtain any approvals that are the Customer's responsibility;

  • ensure required prerequisite work is completed;

  • make payments when due;

  • follow reasonable care and maintenance instructions; and

  • promptly notify us of any issue with Products or Services.

20. Payment overdue

Invoices are payable according to the payment terms stated on the relevant Quote or invoice.

If an amount becomes overdue, we may contact you to request payment.

Where legally permitted and reasonably appropriate, we may:

  • suspend further work;

  • delay ordering or manufacturing;

  • postpone installation;

  • withhold delivery; or

  • take other reasonable steps to recover amounts properly due.

We will not use this clause to avoid or restrict any rights the Customer may have under applicable law.

21. Consumer guarantees and Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot legally be excluded, restricted or modified.

Where the Australian Consumer Law applies, Customers may have consumer guarantees relating to Products and Services.

Depending on the circumstances, these may include guarantees that:

  • Products are of acceptable quality;

  • Products are reasonably fit for a disclosed purpose;

  • Products correspond with their description;

  • Services are provided with due care and skill;

  • Services are reasonably fit for a purpose communicated to the supplier; and

  • Services are supplied within a reasonable time where no time has been agreed.

  •

If you believe a Product or Service does not comply with an applicable consumer guarantee, please contact us as soon as reasonably practicable so that we can assess the issue and discuss an appropriate remedy.

The remedy available will depend on the circumstances and applicable law.

22. Faults, defects and warranty claims

If you identify an issue with our Products or Services, please contact us and provide reasonable details of the issue.

Where appropriate, we may request:

  • photographs;

  • a description of the issue;

  • the date the issue was noticed;

  • information about how the Product has been used; or

  • access to the Product or property for inspection.

We may inspect the issue before determining the appropriate remedy.

Nothing in this section limits your rights under the Australian Consumer Law.

23. Manufacturer warranties

Some Products may be supplied with a manufacturer's warranty.

Where applicable, we may assist you with a manufacturer's warranty claim.

A manufacturer's warranty is separate from any rights you may have under the Australian Consumer Law.

A manufacturer's warranty does not replace or limit applicable consumer guarantees.

24. Care and maintenance

Products should be used and maintained in accordance with applicable manufacturer or supplier instructions.

Damage caused by circumstances outside the intended use of the Product may not be covered by a manufacturer's warranty or other voluntary warranty.

Examples may include damage resulting from:

  • misuse;

  • abnormal use;

  • excessive force;

  • unsuitable cleaning products;

  • unauthorised modifications;

  • impact;

  • water damage;

  • improper maintenance; or

  • failure to follow reasonable care instructions.

This does not affect any rights that cannot legally be excluded.

25. Cancellations by the Customer

You may request cancellation of a Project by contacting us in writing.

The consequences of cancellation will depend on:

  • the stage of the Project;

  • Products already ordered;

  • Products already manufactured;

  • materials purchased specifically for the Project;

  • work already completed;

  • reasonable costs incurred; and

  • applicable law.

Where the Customer has a legal right to cancel and receive a refund, that right will apply.

Where a Customer cancels without a legal right to a refund, we may retain or charge amounts reasonably attributable to work performed and costs properly incurred, subject to applicable law.

26. Cancellation or postponement by Getta Drawer

We may need to postpone or cancel a Project in circumstances outside our reasonable control, including:

  • supplier failure;

  • unavailable materials;

  • manufacturing problems;

  • serious site issues;

  • unsafe site conditions;

  • significant unforeseen circumstances;

  • natural disasters;

  • government restrictions;

  • transport disruption; or

  • other events outside our reasonable control.

Where this occurs, we will endeavour to notify you and discuss reasonable alternatives.

If we are unable to supply the agreed Products or Services, your rights will depend on the circumstances and applicable law.

27. Events outside our reasonable control

We are not responsible for delays caused by circumstances beyond our reasonable control.

This may include:

  • severe weather;

  • natural disasters;

  • fire;

  • flood;

  • industrial disputes;

  • supplier failure;

  • manufacturing delays;

  • transport disruption;

  • material shortages;

  • government action;

  • utility failures;

  • serious site conditions; or

  • other events outside our reasonable control.

This clause does not remove any rights you may have to cancel or obtain a remedy under applicable law.

28. Photographs of completed projects

With appropriate customer permission, Getta Drawer may photograph completed work for portfolio and marketing purposes.

Photographs may be used on:

  • our website;

  • social media;

  • advertising;

  • Google Business or similar business profiles;

  • brochures; and

  • other promotional material.

We will generally identify the project by suburb only and will not publish the customer's name or street address without separate permission.

Customers may request that project photographs are not used for future marketing.

Our Privacy Policy contains further information about project photography and personal information.

29. Intellectual property

Unless otherwise agreed:

  • Getta Drawer retains ownership of its business names, logos, photographs, website content, drawings, designs, documents, templates and other intellectual property;

  • Customers receive a licence to use documents supplied to them to the extent reasonably necessary for their own Project; and

  • Customers must not commercially reproduce or exploit Getta Drawer intellectual property without written permission.

The Customer retains ownership of information and materials that they independently provide to Getta Drawer, subject to any rights we may have to use those materials for the Project.

30. Reviews and testimonials

If you voluntarily provide a review, testimonial or feedback to Getta Drawer, we may use it for marketing purposes where permitted by law.

We will not knowingly misrepresent or materially alter the meaning of a genuine customer testimonial.

If you do not want your feedback used for marketing, please let us know.

31. Website content and product information

We endeavour to ensure information on our website is accurate and current.

However, website information may include:

  • general descriptions;

  • photographs;

  • supplier information;

  • indicative pricing;

  • examples of completed work; and

  • information that may change over time.

  •

Actual Products and Projects may differ depending on the specific Quote, materials selected, measurements and site conditions.

Where a specific Quote or written agreement applies, that document will generally determine the Products and Services being supplied.

32. Third-party products and services

Getta Drawer may supply Products manufactured or provided by third parties.

Third-party Products remain subject to the applicable manufacturer's specifications and any applicable manufacturer's warranty.

Nothing in these Terms limits your rights against Getta Drawer under applicable law.

33. Liability

To the maximum extent permitted by law, Getta Drawer is not responsible for loss caused by circumstances outside our reasonable control or by inaccurate information supplied by the Customer.

However, nothing in these Terms excludes or limits:

  • liability that cannot legally be excluded;

  • rights under the Australian Consumer Law;

  • liability arising from our fraud or wilful misconduct; or

  • any other liability that applicable law prevents us from excluding or limiting.

Where the law permits a limitation of liability, any such limitation will apply only to the extent legally permitted.

34. Australian Consumer Law prevails

Nothing in these Terms is intended to:

  • exclude consumer guarantees;

  • prevent a Customer from exercising a legal right;

  • create a misleading impression about a Customer's rights; or

  • otherwise operate contrary to the Australian Consumer Law or other applicable legislation.

If any provision of these Terms is inconsistent with a mandatory legal requirement, the mandatory legal requirement will prevail to the extent of the inconsistency.

35. Dispute resolution

If you have a concern about a Product or Service, we encourage you to contact us first so that we have an opportunity to investigate and resolve the issue.

Please provide:

  • your name;

  • project details;

  • details of the issue;

  • relevant photographs or documents; and

  • the outcome you are seeking.

We will endeavour to respond within a reasonable time.

If the issue cannot be resolved directly, either party may have rights to use an appropriate dispute resolution process or tribunal or court with jurisdiction.

Nothing in this section prevents a Customer from exercising any statutory right or remedy.

36. Privacy

Our handling of personal information is described in the Getta Drawer Privacy Policy. The Privacy Policy forms part of the information provided to customers about how Getta Drawer handles personal information.

37. Changes to these Terms

We may update these website Terms of Service from time to time.

The latest version will be published on our website.

However, a change to these website Terms will not automatically alter a Quote or Project that has already been accepted unless the change is otherwise agreed between the parties or permitted by law.

38. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or removed to the extent necessary, and the remaining provisions will continue to operate to the extent permitted by law.
